Terms of Use

1 Acceptance of Terms and Registration

By creating an account or using the Smart Ostad platform in any way, you acknowledge that you have read these Terms of Use and the Privacy Policy and agree to be bound by them. If you do not agree with any provision, you must not register on the platform or must stop using it. The information you provide when registering (name, email address, phone number, date of birth) must be accurate, complete, and up to date, and you are responsible for keeping your account credentials confidential and for all activity carried out through your account.

2 Eligible Ages and Parental Consent

• Users aged 13 and above may create an independent student account and use the platform directly.
• For students under 13, a parent or guardian must create or approve the account and link it to their own account through the guardian-linking system, and takes on responsibility for supervising the child's use of the platform.
• The platform may request additional proof of age or parental consent at any time, and may temporarily suspend the account until this requirement is met.
• "Teacher" and "Guardian" account types are exclusively for adults (18 years and above).

3 Account Types and Their Permissions

• Student account: access to the digital library, joining study rooms, using AI tools, and participating in chat within permitted limits.
• Teacher account: creating and managing study rooms and live classes, uploading educational content, tracking student progress within their rooms, and generating quizzes.
• Guardian account: linking to a child's account through the invitation system, and monitoring their academic progress and general activity within the limits the platform allows, without access to their private conversations except as provided for in the Privacy Policy.
• Administrator account: administrative privileges for managing content and users and ensuring compliance with these terms, reserved for the platform's team only.

Impersonating a teacher or administrator, or using an account with privileges that do not match your actual status, is prohibited.

4 Content Rules and Intellectual Property

The platform is intended for educational purposes only. When uploading or posting any content (files, messages, comments, questions), you are prohibited from:

• Uploading unlawful, offensive content or content contrary to public decency.
• Uploading content that infringes a third party's intellectual property rights without authorization.
• Publishing false or misleading information presented as official educational content.
• Using the platform for unauthorized commercial or promotional purposes.

Content created by users (such as files and quizzes) remains their own property, while granting the platform a non-exclusive license to display and store it within the service. The platform reserves the right to review and remove any published content that violates these terms.

5 Use of AI Tools

The platform's tools (the study assistant, study planner, flashcards, and quiz generator) rely on artificial intelligence technologies, and are learning aids only, not a substitute for a teacher or an official educational institution. AI answers may contain errors or inaccurate information, and it remains the user's responsibility (or the guardian's, for minors) to verify information against the official curriculum. These tools must not be used to complete homework or exams on a student's behalf in a way that violates their institution's rules.

6 Chat and Study Room Conduct

• Mutual respect must be maintained in all conversations, rooms, and live classes.
• Any form of harassment, bullying, or hate speech is strictly prohibited.
• Sharing another party's personal data (such as a phone number or address) without their permission is prohibited.
• Sending spam messages or suspicious links via chat or rooms is prohibited.
• Teachers are responsible for supervising the rooms they create and ensuring members comply with these rules.

7 Guardian-Linking System

The guardian-linking system allows a link to be created between a student's account and their guardian's account through an electronic invitation approved by both parties. Once linked, the student (or their presumed consent, if a minor) grants the guardian the ability to view their academic progress and general activity on the platform, not including the content of their private conversations except as permitted by the Privacy Policy. The guardian or an adult student may unlink the accounts at any time from the account settings. The guardian is responsible for the accuracy of the information provided when creating an account for a minor child.

8 Limitation of Liability

The platform is provided "as is" and "as available," without any express or implied warranties regarding it being entirely free of errors or continuously available. Content available on the platform, including AI tool answers, is supplementary educational content and does not replace the official curriculum or an educational institution's assessment. The platform bears no responsibility for exam results or academic grades resulting from the use of its tools. Nor does the platform bear responsibility for any indirect damages resulting from a user's misuse of the service; each user (the teacher for their room's content, the student for their personal use) remains responsible for complying with these terms and applicable laws.

9 Suspension and Banning

The platform reserves the right to suspend, ban, or delete any account, temporarily or permanently, without prior notice in serious cases, if its holder:

• Violates any provision of these terms.
• Posts inappropriate content or content offensive to other users.
• Attempts to hack the platform or harm its security or stability.
• Impersonates someone they are not or provides false information when registering.

A user may appeal a suspension or ban decision via the Contact Us page. Any user may also voluntarily delete their account at any time from their profile settings.

10 Platform Intellectual Property

All original elements of the platform (trade name, logo, design, software, and the structure of official curriculum-aligned content) are the exclusive property of Smart Ostad or its licensors, and are protected under Moroccan and international intellectual property laws. Copying, redistributing, or commercially exploiting these elements without prior written permission is prohibited. This does not affect users' ownership of their own content as described in the "Content Rules" section above.

11 Governing Law and Dispute Resolution

These terms are governed by and construed in accordance with the laws applicable in the Kingdom of Morocco. Should any dispute arise relating to the use of the platform, the parties are encouraged to first seek an amicable resolution by contacting our support team directly. Failing that, the competent Moroccan courts shall have exclusive jurisdiction over the dispute, unless the law provides otherwise. These terms may be updated periodically; users will be notified of any material change, and continued use of the platform after an update takes effect constitutes acceptance of it. In the event of any conflict between versions of these terms in different languages, the Arabic version shall prevail.
